Jury appears set for Delaware River boating death trial

Both sides are preparing to deliver opening statements in the case of Donald Jessamine.



Opening statements in the trial over a 2012 Delaware River boating death are expected to be delivered Tuesday.


Nearly a week after the selection process began, a jury to hear the case against Donald Jessamine was tentatively set Monday.


The Phillipsburg resident is charged with second-degree vehicular homicide and first-degree aggravated manslaughter.


Jury selection began last Tuesday. Warren County Prosecutor Richard Burke and Jessamine's attorney, Michael Priarone, brought in three pools of potential jurors before saying Monday afternoon that they were satisfied with the panel of 14.


The jury pool will return to state Superior Court in Belvidere on Tuesday morning. Judge Bruce Jones said that barring an unexpected development, he plans to swear in the jury, rule on some final legal matters and proceed with opening statements.

Authorities allege Jessamine drunkenly drove a jet boat June 23, 2012, into boulders in Harmony Township, sending him and his passengers, Lane Alden and Jerry Robbins, into the river.


The two men made it to shore. The 57-year-old Alden's body was recovered in Williams Township five days later. She died of blunt force trauma.


Jessamine faces 30 years in prison if convicted.


In a heated debate in open court late Monday afternoon, Priarone and Burke argued over how the results of Jessamine's sobriety tests will be used when charging the jury. Jones will rule on the matter Tuesday morning.


The breath test administered several hours after the accident showed Jessamine's blood-alcohol content was .09, according to court records.


The trial is expected run Mondays to Thursdays and last eight days, possibly as many as 15, not including jury selection and deliberations.
