Man assaults officer trying to help with injury, cops say

The man repeatedly resisted medical assistance, police said.

A drunken Independence Township man injured when he fell off a bicycle is accused of attacking the police officers who tried to help him.

At 2:10 p.m. Sunday, Hackettstown police officers found Brian McElwaine, 29, along Route 604 near NAPA Auto Parts. McElwaine suffered an injury in the fall and became combative when officers attempted to escort him into an ambulance, police said.

He pulled away, clenched his fists and resisted medical assistance, police said, describing McElwaine as "aggressive." Police handcuffed McElwaine and placed him under arrest.

As McElwaine was being placed in the back of a patrol car, police said he kicked an officer in the hand and forearm. He allegedly went on to kick the interior rear passenger side door.

McElwaine is charged with aggravated assault on law enforcement officer and disorderly conduct.  He was sent to the Warren County jail in lieu of $5,000.
