Jurors rehear co-defendant's testimony in 2012 Phillipsburg murder case

The second day of deliberations also included video of the defendant's statement to police.



The second day of deliberations in a 2012 Phillipsburg murder case concluded with jurors rehearing statements from both the defendant and an alleged cohort in the crime.


Andy Torres, 26, of Allentown, is standing trial on charges of murder, felony murder, armed robbery and related counts in the death of 47-year-old gas station attendant Kismathdas Kasam. Torres faces 30 years to life in prison if convicted.


Torres allegedly shot the South Main Street BP attendant early Jan. 5, 2012, during a robbery planned and carried out with three others.


The jury of five men and seven women, plus a man and woman as alternates, began deliberations Tuesday afternoon.

They returned Wednesday to rewatch an hour-plus video of Torres' statement to police following his arrest. During the trial, Torres said he lied to police to cover for the others involved, one of whom was his girlfriend. The prosecution has said Torres' original statement was too detailed to be made up.


Wednesday afternoon, the jury requested to have the entire testimony of David Beagell read back to them. Beagell, of Blakeslee, Pennsylvania, is the only one of three co-defendants to testify.

Beagell said Torres was involved in the planning of the robbery, carried it out and shot Kasam. The defense has argued that Beagell is a dubious source based on admitted falsehoods about details in his own statement to police.


The stenographer's read-back of Beagell's testimony will continue Thursday morning. Deliberations are to continue Friday if necessary.
