FLEMINGTON - James Costley, III, 64, of Asbury, has been indicted on one count of fourth-degree assault by auto for a June 1 accident in Clinton Township.
The indictment, unsealed Monday, was handed down in July by a Hunterdon County Grand Jury.
According to police, a 44-year-old Washington man riding 1987 Harley-Davidson FXR was leaving the Riley & Jakes Restaurant at 8:10 p.m. along with other motorcyclists.
As they turned north on Route 31, Costley, driving a 2005 Chevrolet Silverado north on Route 31, reportedly attempted to pass the Harley-Davidson on the right. Witnesses said Costley allegedly jerked the wheel of his truck in the direction of the Harley-Davidson, colliding with it, police said.
The Washington man was thrown from his motorcycle and taken to Hunterdon Medical Center in Raritan Township for treatment of lacerations to his arms and back, as well as a broken ankle, police reported.
Costley with arrested and charged with assault by auto, reckless driving and improper passing. Police said he reported that when he pulled over, he exchanged words with - and was punched in the face - by other motorcyclists who were riding with the victim. He was told he could go to the Clinton Township Municipal Court if he wanted to sign complaints, police said.
If convicted of fourth-degree assault by auto, Costly faces up to 18 months in state prison and a $10,000 fine.
